Residence Permit in Serbia for Retirees: Routes, Documents and Deadlines

Guides · Exgentum · Serbia

Serbia has no retiree visa of its own, and the Foreigners Act does not name a pension as a ground for residence. Anyone seeking a residence permit as a retiree in Serbia generally enters visa-free (up to 90 days within 180 days) and applies for a temporary permit on a statutory ground, such as ownership of an apartment they live in themselves or family reunification. The pension serves above all as proof of means of subsistence, and the application should be filed in good time before the permitted length of stay expires.

This article is aimed at people who want to spend their retirement in Serbia and explains step by step which permit comes into question, which documents are required and where the most common mistakes lie. The general rules on residence are in the article Residence permits in Serbia (in German). Here we deal with the particulars for retirees, from the first thought to the extension.

Is there a retiree visa for Serbia?

No. Art. 40 of the Serbian Foreigners Act (Zakon o strancima) lists the grounds for a temporary stay, including employment, family reunification, treatment or care, property ownership and other justified reasons. There is no category for retirees. A pension is therefore not a ground in itself, but it can help to show that you can support yourself.

The distinction between two things is important:

A stay expressly regulated solely on the basis of pension and savings, often called "passive residence", is not contained in the list in Art. 40. At most the open ground of other justified reasons (Art. 40 para. 1 no. 14) could apply, on which the authority decides case by case. Have this point clarified before applying and do not build your planning on forum posts by other retirees.

Three routes that come into question for retirees

Residence through property ownership

Anyone who owns an apartment or a house in Serbia and also lives there can apply for a temporary residence permit on this basis (Art. 54 of the Foreigners Act). Commercial space or a pure investment property in which you do not live does not meet this description. Art. 54 names no minimum value, it is not an investor programme, and here too you must prove the general requirements such as means of subsistence and health insurance. The limits of this route are described in our article Golden Visa Serbia: Myth and Reality. Note two points:

Residence with sufficient own means

Sufficient means are a general requirement under Art. 43, but not a ground for residence in their own right in the law. You should therefore not take it for granted that your case will be recognised as another justified reason. We have not found a statutory minimum pension; the regulation names only the minimum wage as the yardstick for the account balance. Ask the competent police authority what it currently requires, and keep your pension notice and account statements ready.

Residence through family

If you are married or in a registered partnership with a person who has citizenship, temporary residence or permanent settlement in Serbia, family reunification comes into consideration under Art. 55. Spouses of Serbian citizens do not have to separately prove means of subsistence and health insurance under Art. 43a. Parents of adult children do not normally belong to the closer family. Exceptionally, other relatives can be included if they are dependent and have no adequate family care in the country of origin (Art. 55 para. 3). For people of Serbian origin, Art. 68 provides for permanent settlement even without the usual three-year period. Clarify exactly which status the reference person has before you build an application on it.

The process step by step

  1. Visa-free entry. As a German, Austrian or Swiss citizen you may stay in Serbia without a visa for up to 90 days within 180 days. Short border crossings do not reset this period, because the count runs over every period of 180 days.
  2. Registration of accommodation. Every accommodation must be registered with the police within 24 hours (Art. 111 of the Foreigners Act). Hotels and landlords or private hosts take care of this, otherwise you register yourself. For violations, foreigners face a fine of 5,000 to 150,000 dinars (Art. 120), and the registration is part of the application documents. How this works is explained in the article on residence registration (in German).
  3. Determine the basis and collect documents. This usually takes longer than you think, because documents from your home country must be translated and certified.
  4. File the application with the competent authority. In person or electronically (Art. 41) and in good time before the 90 days expire.
  5. Wait for processing. The duration varies, nobody can promise an outcome. Anyone who files the application in time may stay until the first-instance procedure is concluded under Art. 41.
  6. Receive the decision and the residence document. Under Art. 44 the permit is valid for up to three years and can be extended.
  7. Plan the extension. You file the application at the earliest three months before expiry and at the latest by the day of expiry.

Which documents retirees need

Art. 43 of the Foreigners Act requires for a temporary stay: a valid passport, proof of means of subsistence, registration of the place of residence, proof of health insurance, evidence of the ground for residence and proof of payment of the administrative fee. The passport must be valid for at least three months longer than the period applied for. For retirees the following are typically added:

Which documents and how many certifications the respective police station requires can differ. Ask for the current list beforehand.

Health insurance: the point that is underestimated most

Serbia is not an EU country, but the 1968 social security agreement with the former Yugoslavia continues to apply between Germany and Serbia. This has an important consequence for German retirees: anyone who receives only a German pension and is compulsorily insured in the German health insurance for pensioners generally remains so under Art. 17 para. 4 of the agreement when moving to Serbia and can receive benefits in kind there. The contributions are withheld from the pension. Anyone who also receives a Serbian pension is, with permanent residence in Serbia, subject to the Serbian rules instead. Privately insured people and pensioners outside the health insurance for pensioners need another solution, and Austria and Switzerland have their own agreements.

For the application, the official portal names for countries with an agreement the European Health Insurance Card or another document on insurance in the country of origin, otherwise a policy together with proof of funds for emergency treatment and chronic conditions. Whether your proof is sufficient is decided by the authority.

In practice this means for retirees:

More on systems and options is in the article Health insurance in Serbia (in German).

Pension, account and taxes: what to clarify in parallel

The residence permit is only one part of the planning. You should clarify three points in parallel:

Pension payment. The German Pension Insurance pays the German pension to Serbia if you live there. Ask in writing about the payment route and account, and think of the proof of life that the pension insurance requires for residence abroad or payment to a foreign account.

Account. Keep your German account at first. A Serbian account makes everyday life easier, but it is opened by the bank and not by an authority. More on this in the article on a bank account in Serbia for foreigners.

Taxes. Anyone who has a residence or the centre of their life and business interests in Serbia, or stays there for at least 183 days in twelve months, is considered resident there under Art. 7 of the Personal Income Tax Act. Art. 9 exempts pensions from compulsory insurance; whether this also applies to a foreign pension is not clear from the wording. How the German pension is taxed depends on the double taxation agreement and on Serbian law. Do not rely on statements such as "pensions are tax-free in Serbia", but read our article German pension tax-free: countries compared (in German) and have your type of pension reviewed by a tax advisor before moving.

Deadlines retirees should know

DeadlineWhat appliesWhat to watch for
90 days in 180 daysVisa-free stay (Art. 16)File the application in good time beforehand, not on the last day
Registration of accommodationWithin 24 hours (Art. 111)Report a later change of address within three days (Art. 110)
ExtensionAt the earliest three months before expiry, at the latest by the day of expiry (Art. 41)Allow lead time for documents
Permanent residenceAfter three years of uninterrupted temporary residenceApplication at the earliest 60 days before expiry, at the latest on the day of expiry
AbsencesPermitted to a limited extent (Art. 67)Repeatedly up to ten months or once up to six months

The details on permanent residence come from Art. 67 of the Foreigners Act and from the official website of the Serbian government (welcometoserbia.gov.rs). According to this source, anyone who files the application in time may stay in the country until the end of the procedure. The difference between temporary and permanent residence is explained in the article Boravak and permanent residence.

Typical mistakes with the residence permit for retirees

  1. Choosing the wrong basis for the application. Anyone who forces the situation into an unsuitable category risks a refusal and loses time.
  2. Starting too late. Translations, apostilles and appointments take time. Start well before the 90 days expire.
  3. Hoping for a border crossing. Short trips abroad do not reset the 90 days.
  4. Clarifying health insurance too late. Without valid proof the application is incomplete.
  5. Not extending after the application. The permit expires if you do not extend it in time, and a gap can endanger the later application for permanent residence.
  6. Closing the German account too early. Keep a fallback until the pension payment in Serbia arrives reliably.
  7. Buying a property immediately. Rent for a while first before you commit.

Frequently asked questions

Is there a retiree visa in Serbia?

No. Retirees apply for a temporary residence permit on one of the statutory grounds, such as ownership of a property they live in themselves or family reunification. Sufficient means are a requirement, but not a ground in their own right in the law.

How long may I stay in Serbia without a permit?

Up to 90 days within 180 days without a visa, provided you hold German, Austrian or Swiss citizenship. Apply for the permit before this time expires.

Which documents do I need?

At least a valid passport, proof of the ground for residence, proof of means, proof of health insurance, registration and proof of payment of the fee. Translations and apostilles are often added.

Do I have to buy a property?

No, but ownership of an apartment you live in is expressly named in the law as a ground. Rent beforehand if you are unsure. A purchase is not a duty and no guarantee of a permit either.

When can I apply for permanent residence?

Under Art. 67 of the Foreigners Act after three years of uninterrupted temporary residence, with the application at the earliest 60 days before the existing permit expires. Absences are permitted only to a limited extent.

Conclusion

The residence permit for retirees in Serbia is feasible, but not automatic. There is no retiree visa, so you must assign your situation to one of the existing grounds for residence, assemble the documents early and solve health insurance cleanly. Anyone who has deadlines in the calendar, clarifies the pension payment beforehand and discusses the tax side with an advisor avoids most mistakes.
